First of all Congratulations desi#### and thanks for continuing to support IV.
Interesting discussion going on. Yes, I agree that most of us here are waiting for our GC and some of them go on to become US Citizens.
I believe that becoming a citizen of any country is a person's choice, so let us not give desi### a hard time here.:o
But I certainly do not think it is an 'achievement' to get a US citizenship, just because it implies indirectly it is an 'achievement' to let go off Indian citizenship. Nothing meant to offend you desi#### but it hurts when one reads such a statement somewhere deep inside the mind. But hey, as I said earlier, to each his own and noone should be judging others in their decisions.
And it is not only Indians becoming US citizens every year. There are others too.
Personally, even with all the advantages as stated above of being a US citizen, I will never let go of my Indian passport. Even if the authorities give it to me tomorrow in a lottery;) Never.
Why? Because my identity, my rich heritage, my family roots, my parents, my culture everything is Indian and am proud of it. There are lot of sentimental and emotional attachments. I was going through the OCI articles today after reading this discussion.
It is not exactly a dual citizenship. Some clauses are no voting rights! No Indian Passport!
Getting a GC is another thing, but when I decide to go back after a couple of years, I would definitely want to retain my voting rights. ! I rest my case.
US citizenship is a final stop for most/many immigrants. Post Sep 11, there has been a surge in nationalization applications because technically GC is like a long term visa to stay permanently. Therefore there is always a risk of losing GC because of DUI or other trivial or accidental issues etc.
Also post Sep 11, a lot of govt/sensitive projects that were available for GC only have been restricted to US Citizens. You lose a significant chunk of the available jobs market if you are a GC holder in the Maryland/DC/North Virgina area. In fact I know a lot of GC who kept their old passports but because of these hassles eventually decided for Naturalization.

I thought we are all equals, unless you think you are challenged in anyways - physically or otherwise, in that case I agree, you are 100% right, there must be a special quota for you. For all others who consider themselves to be equal shareholders to the free society, isn't preferential treatment for any set of people "wrong" and "unfair"? Just asking? I mean are we not equals, if yes, then there should be no quota for any country, if no and you think you are superior, which maybe true, then I should get preferential treatment, if no, and you think you are inferior or otherwise challenged in anyways, well, in that case yes, you sure should be treat better than others.... you know....

Replace money by applicants and replace investors by countries, and you will get a sense as to why per country quota is implemented. I agree it is hard to digest the per country quota, but it is what it is. It is affirmative action if you will. It requires equality, but gives some buffer to people not properly represented (or run the risk of being overwhelmed by any single country).

You guys are amazing.. I have one hypothetical question.. Please pls let me know what you would have done in the below scenario. I think a simple yes or no answer is what I am looking for.
PD is Apr 06 - I-140 approved - Currently Unmarried � WILL TAKE ATLEAST ONE YEAR BEFORE I GET MARRIED - My Spouse will be residing in India at the time of marriage - Spouse would not have any valid U.S visa (H1 or L1).
I have read this thread and others, and I think I understand a little on how the process works. I am looking for your gut-feeling answer if I should apply for 485 or wait till I get married. Let�s assume that my marriage will take place only after one year from now.
I know it�s a very very tricky situation, I am very confused. Obviously, my preference is to wait for a longer time to get my GC, than separated from spouse for years.
Should I apply for 485 or not?
There are so many stages where you can apply the breaks. Like if you get your FP too soon..you can reschedule the date or even withdraw the I-485 application later. Other option is to convert to CP. There are so many options and talk to your attroney.
I feel you should file now, try to do civil ceremony done in india in 30-45 days so you are safe.

Does you think it might be possible that USCIS could hold the AOS application and automatically process the application with out any refiling cost ...with or With out encashing the checks...

If you have health insurance (which I doubt) go to some doc. and get some life injected. That will certainly help you in your current situation and you may be able to jump to EB1.:D

FYI ...With support from a few people .. we are in the process of filing a Direct injunction for stoppage and immediate audit of interfiled/approved cases. But more support would be appreciated.

EB3 can accomplish anything that EB2 can, based on their work experience, but some people don't understand that.
My personal opinion is that other than few algorithm, electrical design, compiler design kind of jobs, most jobs in Computer applications can be done by an EB3/EB2 person. It's only how your company treats a particular job opening that you get designated as EB2/EB3. I could file in EB2 and lots of top-rankers from my class could only file in EB3. Does that make them any less capable than me?? Nope!

EB3 I is going to have a long wait. I had applied for Canadian green card and had received it. At present i have EAD and AP. Is it worthwhile to go into consular processing and work in canada or apply for a blue card or think about Australia. If this sounds okay how should i proceed.

What is your PD? Your profile says you are July Filer and your labor approval date is in 2008. Maybe a typo? I think if your PD is before 2003 for EB-3 I, there is hope of getting GC by end of 2010. Otherwise, it could be a really long wait without any legislative changes.

Why dont you call VFS and find out what's happening and if they can help you to resolve this?
I might have more information than VFS. The VFS agents don't know what's happening in the consulate. The agents doesn't know more than what is already present in the VFS website.
