I would think IT experience is the same anywhere so taking it to canada should be ok? If not there are plenty of other management jobs there. It might be a new start but in a one year timespan you will be well established.

As for masters, are you persuing MBA? How about PMP?
1. Apply for Canandian PR and then if you are lucky you may get a good job in Canada in IT or else you will end up working in Wal*Mart or some grocery store cursing why you came here. Canadian Companies wants Canadian experience. US experience is not enough! :(
2. Just enjoy without doing anything and hope that your GC would come before you die. :D

My reading is that sensenbrenner seems to be open to consensus...and amenable to comprehensive reform (which in other words is tougher border security and interior enforcement + guest worker program similar to Coryn-Kyls'). Despite public rhetoric, if there is enough time we may see such legislation come to pass in the 109th Congress. We need to see how we can bring about meaningful EB visa relief in such a scenario.

The point is what did we lose by calling. It took us a call which any way is free. Took 2-3 minutes of our time which other wise we were not planning to use in any other better activity. So even if the campaign fails ( I pray it does not) still we havent lost finacially or in any way. Atleast it brought so many people together to do something constructive. Made people understand how a bill works in senate.
To your other point that senetors do not care about non voters then then the only other way is lobbying and paying for campaign funds. Can we do that the answer is plain NO. Most people on H1B are working for blod sucking consultants who pa them far less than what they deserve. How much can they contribute financially if they have dependent wife an kid here and parents in home country. Add to this the job insecurity in current market and there is no guarranty that paying one time will bring any results. Least this way every one contributes.

I'm sure there are some intelligent and caring lawmakers somewhere who listen to legal immigrants' plight. They don't seem to be in enough or meaningful numbers. Most are interested in either keeping their seats or serving a subsection of their community.
Again, I believe they are moved mostly by lobbyists and other power groups. I don't yet fully understand how much power IV can wield, but IV could be one such group.
Lawmakers care about high-skilled immigrants only because people like B. Gates, Compete America and such keep lobbying any and all the time.
BTW, I'm not at all short-sighted about this. I'm just more realistic about how things happen in Washington. Need proof: For example, look at the staffers on McCain's campaign. Most are lobbyists. Understanding how democracy works in America and commenting about it is what the real big picture is.

But one of lawmakers duty is to build the next generation America, and "immigration" bills benefit next generation America. People got to understand this fundamental difference and stop being pessimistic about IV efforts.

Here are the few main reasons for retrogression to India and China etc are
1) When H1B quota is 65, 000 the GC visa number is 140, 000 . But when they increased H1B from 65,000 to 195,000 the did not incresed GC visa numbers.
2) There is no country quota in H1B ( other than Chile and one more country for 7,000) visas. So most of the H1b's are issued to few countries like India,China and Philippines. But when we come to GC visa there is country quota.
3) We all know about that ilegal immigrants used some GC numbers which are meant for EB people.
We need to educate the USCIS why and how we are suffering in getting GC.

We all know about supply and demand theory which causes black marketing.
Selling of approved labour ( which has old PD ) is also same thing.

Well said and I agree. USCIS can be more transparent and be clear. They can always tell us that it would take X years and people can plan better and decide accordingly. Why cant they do it is beyond my reasoning. Frustrating part is they wont do that! Everyone makes alternate plans and has a threshold for waiting. I guess this is what nitinboston was trying to say that dont be obsessed about it. Many people took it wrongly and started called names which just shows immaturity. Anyways, GC or no GC one should live happily wherever that be :-)

PLEASE HIGHLIGHT RE-CAPTURE OF WASTED VISAS
AND CHANGE IN THE LAW TO VISA ROLL-OVER IN FUTURE.
I think asking for increase in visa numbers works against us, especially in this economy. They may not be interested in removing per country quota too.
But, we have a genuine and strong case regarding re-capture of wasted visas. The root of this evil (retrogression) is due to wasted visas in last 5/6 years. Its quite simple math, US didn't stop/reduce H1 visas who get into the GC pipe, but reduced the number of people going out of pipe, hence the congestion.
Please make sure u highlight this one. This should be top most priority all the time.

I have been in line and have applied for a greencard 6 years ago and my application has been shuttled through various departments and agencies in a 4 step procedure and now being stalled for want of a number (An immigrant number) for a highly skilled immigrant. There are an estimated 1/2 million legal law abiding, tax paying individuals in a similar situation who need your attention. All of them are in the country on a work visa and are in line to recieve an employment based green card.
The Employment based green card system is completely broken due to excessive delays and backlogs in petitions of nearly half a million highly skilled workers who are certified by US Government to be doing a job that no US citizen is willing, qualified or able to do. The delays in obtaining a permanent residency are due to 2 reasons: Numerical caps on employment-based green cards and processing delays in adjudication of files. Today the system takes anywhere between 6-12 years to grant Green cards to some of the best and brightest of the world who have chosen America as their future home.
These future Americans are facing huge quality of life issues and their employers are facing difficulty in attracting more of the best and brightest of the world due to the broken system. The system prevents these workers from accepting promotions and switching jobs for the time-period it takes to process their files. By stagnating career growth and suffocating the creativity of the most innovative and technical minds of the world.
The processing delays mock America�s respect for those who �play by the rules� and get in line. At the same time USCIS awards 10s of thousands of greencards to people every year outside of USA based on a pick or lottery.
At the end of 2006, there were an estimated 200,000 employment-based principals waiting for labor certification, which is the first step in the U.S. immigration process. The number of pending I-140 applications, the second step of the immigration process, stood at 50,132. This was over seven times the number in 1996. The number of employment-based principals with approved I-140 applications and unfiled or pending I-485s, or the last step in the immigration process, was 309,823, a threefold increase from a decade earlier. Overall, there were 500,040 employment-based principals (in the three main employment visa categories of EB-1, EB-2, and EB-3) waiting for legal permanent residence. And the total including family members was 1,055,084.
These numbers are particularly troubling when you consider there are only around 120,000 visas available for skilled immigrants in the EB-1, EB-2, and EB-3 categories. To make things worse, no more than 7 percent of the visas are allocated to immigrants from any one country. So immigrants from countries with large populations like India and China have the same number of visas available (8,400) as those from Iceland and Poland.
At the same time, a debate rages about H-1B visas and this gets considerable press coverage. Companies such as Microsoft, Intel, and Oracle have been lobbying for visas to bring in skilled immigrants, but have focused on expanding the numbers of H-1B visas available. Why? Perhaps because workers on these visas are desirable, as they are less likely to leave their employers during the decade or more they are waiting for permanent residence.
So we want skilled immigrants, but we want them to come on the right visas as permanent residents. The battles being fought are about bringing in more people with H-1B visas�not about those who are already here with them and stranded in �immigration limbo.�
Unlike many of the problems facing the United States, this one isn�t hard to fix. All we have to do is to increase the number of visas offered to skilled workers in the EB-1, EB-2, and EB-3 categories from 120,000 to around 300,000 per year. And we need to remove the per-country limits. Instead of requiring graduates from top universities who receive jobs from American corporations to go through the tedious H-1B visa process, we should provide a direct path to permanent residence. We are now competing with the rest of the world for the best talent. One more most important aspect is also to provide an oversight over USCIS. Presently, processing delays, lost paperwork, incourteous and bad customer service and above all a non-transparent system is what immigrants face. Very true. Also members should stay away from promoting one presidential candidate versus other. How does it help our cause? This has nothing to do with free speech. There are so many other websites for such discussions.
Though I agree wholeheartedly that this is not a platform for supporting any of the candidates in the Nov election, but given that more than 90% of the people who frequent this forum are not even citizens of the country and cannot vote... Even if I get hugely motivated towards any of the 2 candidates, by reading the motivational messages from other fellow posters, what can I really do ?
I cannot vote...so how does it matter ?

does kaiser provide insurance for visitors?
I am also shopping for my parent's insurance coming to US next month. I found the coverage by TATA AIG better than ICICI. The HMO plans for Kaiser is also good but expensive. United Health care does not provide insurance if the applicant doesn't have SSN.

I like your response, really -- I think it's frank and hits upon what it means to be Indian at heart.
BUT, when one makes a decision to immigrate - he/she's not just making that decision for himself - but also for his/her spawns and the future generations to come. Is it fair for us to rob them of (well, i know most american born desi kids don't care a rats ass about going/being in India) - what it feels to be an Indian at Heart? what it 'Really' feels like to be watching/talking cricket/movies on 'em gullies, what it's like to be eating gaadi chaat, what a festival should really feel/look like .. and a bunch of other stuff- -that happens only in India.

BUT, when one makes a decision to immigrate - he/she's not just making that decision for himself - but also for his/her spawns and the future generations to come. Is it fair for us to rob them of (well, i know most american born desi kids don't care a rats ass about going/being in India) - what it feels to be an Indian at Heart? what it 'Really' feels like to be watching/talking cricket/movies on 'em gullies, what it's like to be eating gaadi chaat, what a festival should really feel/look like .. and a bunch of other stuff- -that happens only in India.
not trying to discount anyone's opinions .. it's just the internal dilemma that needs addressing

Thank you for the reply. When you say that if I go with Company A that there will be more scrutiny, do you mean they will check the vailidity of the offer and their ability to pay? I work for a Govt. Agency(Company C), they will give me an EVL but I am not sure if they will specify "in accordance with I140". I am actually doing the same job, same place, before as a contractor(Company A) and now as an Employee(Company C).
This is what you could do. Take the updated EVL letter from your HR/ Supervisor. Attach latest paystubs as additional proof. Now for duties if the EVL does not contain this info then attach a copy of job posting advertisement that was issued when you were hired. Every govt job needs to be advertised. It can be in papers or their own website. Then get the lawyer to draft the AC21 letter and to point out the similarities between this job and your labor.

Small query. If I am in my sixth year of H1B today, and if I file for H1 extension,
1. with same employer, I actually got 3 years extension. (being 140 approved)
2. with diff. employer, would I get 3 years or just six months, or not at all?
With different employer, you can get 3 years as well, if the new employer has filed for a new PERM and you have received an approved I-140.

not sure how to do this. can some one in this thread create a poll just for eb3-India just to see a ball park number of people waiting in eb3 india and for how long they are waiting (may be we can start from jan 2001 all the way till jun 2008). This atleast would give us an idea of how many IVers are waiting in eb3 queue..pls discard if you did not like this idea. thanks.

If an American citizen wants 100K and the GC holder wants 90K and the H1-B visa guy wants 80K (and all of them are going to work in the same city and same office) the job is worth 80K.
I would strongly disagree that H1 = cheap labor. It's only the H1B employer who pays low salaries, where as the client pays the same billing rate to all contractors (including US citizens). If a h1 employee is getting a low pay, then there's no one to blame except the employee, cuz he's allowing himself to get exploited.
I work for a major US corporation. I have seen H1 - LCA notices on my office notice board with salaries ranging from $100K to $110K. I personally know a friend who earns $100K on H1 and also an US citizen who earns $85K in the same office.
I have seen H1 holders driving Merc/BMW, whereas GC holders/Citizens driving a rundown Honda or Toyota Corolla.
Recently, one of my friend left his desi employer who was paying him $75K per annum and joined an US corporation by doing a H1 transfer for an annual salary of $135K per annum.
It all depends on your skills and how benefitial you are to the company. If you wanna reach the stars, then no one's gonna stop you.
