    Also, if what you are saying is correct- then DOS will immediately post a revised September 2008 bulletin to show India/China 'U'. So, that fresh I-485 filers won't be able to file. We have not seen such action on the part of DOS.

    For example- Last year when they made July VB Unavailable on July 2, 2007; after adjudicating 25000 applicationsover the Jun. 30- Jul. 01 weekend , they immediately made an announcement on July 02, so no fresh I-485 applicants can file. The rest is history...


    You said that you are from the Midwest, but your profile says that you send your application to Texas. How is that possible, All midwest I-485 applications must have gone to Nebraska Service Center.

    ya, lets step-up a poll and have everyone vote, as if this is the US congress. And after voting leave it for someone else to work on this and other "brilliant" idea. There needs to be a reality check. This poll doesn't mean anything unless there are enough people to spend time and energy at every level. But ya, lets setup a poll and have everyone vote, it will give everyone a feel good factor that everyone contributed in the advocacy effort, how? by voting in the pool and not doing anything about how everyone votes.

    abolish per country limits on EB visas will back fire us because of diversity issue. We should propose some thing where there is no controversy to reject and that's is recapture 200K visas and EAD/APO for 3 years

    Why not filing 485 without PD being current?

    I am from AZ and Sherrif Joe is the best and the whole country should be proud of him.
    He is doing the job which is supposed to be done by Federal govt and ICE, trying to take care of a border state county.

    Thanks for your suggestion. But the problem is its not that simple. Here is why. If the same individual create multiple IDs on IV and post using multiple IDs, one for posting derogatory comments and others that are not derogatory, we can keep mum to a point, but then it just gets too frustrating. Like in this case, madhuvj and GCStatus is the same person posting from the same machine but posting as if you are two different individuals. Hence my posts. Please stop this and email/pm us your phone number and we will start the transition process. We are sure you will do a better job than us.

    You see, just like everyone else, we also have limited number of hours in a day. We can either spend our time looking at who is using multiple forum ids to post similar messages creating a false impression for other forum visitor, like the one projected in 'if i can be blunt' thread, or we can spend our time doing better things. Your actions are not helping anyone including yourself. Hope you understand.

    We have 1485$ holiday contributions so far and one 50$ contribution on this thread. We need more.

    Here is something to read for you:

    IV in 5/2006:

    About 4000 members, 2800 of which had not contributed anything, and even then IV managed to pull off this amazing feat.
    This amendment was PASSED although the CIR bill failed to survive.
    In other words, if there had been a bill only to address EB GC reforms, there was a great chance YOU would be able to file for your I-485 even if your PD was not current!

    IV in 11/2007:
    1) IV has 25000+ members.
    2) The EB GC reforms proposed and passed as an amendment in mid-2006 are long overdue!
    3) IV has gathered a lot of admiration and attention after the flower campaign/ SJ Rally-> leading to the July VB reversal, and of course the DC rally!

    Even if 2500 of them pay $50 a month, IV would have a steady flow of $125000 a month for lobbying efforts.

    Just imagine what IV could accomplish in the next few months, if only people realized how important it is for them to sign up for monthly contributions!

    But seriously growing your own vegetables is a fun activity. I have not done groceries in the last few months (exceptions being junk fast food, yoghurt etc). We grow vegetables all year round. In fact we have excess of most vegetables we grow. Try it, its a lot of fun!

    And good luck to all EB2 and EB3 folks - we've seen good EB2 movement and we hope we'll see more movements in both EB2 and EB3 in the days to come. Till then, Happy gardening!!

    Ok, i had the same problem.

    Surname: blank
    Given Name: First Last.

    But in all US documents had it correctly distinguished. Recently when i renewed my passport i got it fixed at NY. You DO NOT NEED a news paper ad for this kind of change. I went to NY Indian consulate personally to ask this question as no one was lifting the phone. The person over there gave me a special form to fill it out and get it notarized. I did all of that and they printed the name correctly. Another guy had same problem, he did not even filled out that form, but they corrected his name as well. I was surprised how lenient these guys are.

    Me and the other guy were joking on the way back in train because they did it for him without the special application, its like they don't care what name you have, " do you want Tom Cruise, i will write Tom Cruise - no problem at all, or even better, we will give you passports with empty name column, you fill it up with whatever you want :) "

    Don't worry guys, this change is easy and this does not impact 485 as well, as long as you have always reported your correct name in your other USCIS documents. THEY KNOW that internationals have their names goofed up in their passports. Its not new for them.

    I guess My interview didn't go as expected.

    1) I reached the office an hour early.
    2) After waiting,they did security check and let us in
    3) Then the lady who was assigned my case, came and took us into her room
    4) Oath, etc
    5) She then started asking for Birth cert, Marriage Cert, kids birth certi, 140 approval copy.
    6) Then she pulled a file (which was labelled DOS Visa bulletins) and spent around 15 mins on Oct 2007 bulletin.
    7) Then asked us who filed your 485..you did your self or your employer did..we said employer.
    8) Then she said, something is not right..per Oct 2007 bulleting Visa's are unavailable so yours was not filed properly.
    9) Then I said, ours was filed in Aug 8th 2007. She insisted the receipt date is oct 2007..then we showed her our 485 reciept.
    10) Then she thanked us and started looking at Aug 2007 visa bulletin. and said, even then in Aug 2007 EB2 was U, so yours was not properly filed.
    11) I told her, There was an interim Memo released by USCIS that they will accept application until Aug-17 2007 based on July 2007 visa bulletin
    12) She said she will look at DOS bulletins
    13) After 10 mins she said, she cant find any such memo..and said, since there is no evidence with her, she has to deny our case based on "Improper filing when PD was not current"
    14) Then I said, if PD was not current, wouldn't TSC return the application denying on the spot? Why would they accept the application?
    15) She said, you would think so..but they accept many times..so we are told to verify all the time
    16) THen said, she believes us but for process, she needs evidence and said she will look into further and then make a judgment.

    17) We had no choice and we were over the interview. we were little disappointed though

    18) After coming home, I realized she took all I-94s and we got panicked..because if 485 is getting denied and I-94s are gone, how do we prove our legal status, so we thought of going back..then I thought, if have to go anyway, then I should take a print out of Interim Memo

    19) I went back an hour later with the print out
    20) I told security that, we had finished our interview and officer forgot to return our I-94..they insisted that we shud take infopass and they wont allow anyone to go back..I had to really argue with them (I decided I have nothing to loose..anyway 485 is screwed and so stood there asking them to let me in)

    21) After consistent nagging, the security guy took our passports, interview response letter(After interview if your app doesn't get appproved they willgive a kind of reciept saying u attended the interview..blahblah) and went in

    22) Came back and told me to go in since the officer wants more details from you (I thought this was a miracle)

    23) I went inside, and after a while officer came back. We apologized and told her that we came back for I-94s..she said they will retain and wont return..We told her that we are not using EAD and we are still on H1B..she said she will give back..
    then she asked, I am sure you didnt come back for I-94 alone, did you get any document?

    24) We showed her the memo.

    25) She read that and said I am glad you came back..this clears everything out..I will run this by my supervisor and will see if we can adjust status today

    26) We waited for 2 hrs and then she took us inside.
    27) Asked our passports (to stamp...really)

    28) Then she looked into the computer to get the visa #.
    29) The we noticed a changed in her face and then she quickly turned into a folder of current VISA bulletin..we said..oh..no..not again.
    30) The officer said, per visa bulletin u r current and ur PD is dec 2005..there is no reason for system not to allocated a visa #..
    31)She tried for 10-15 mins and finally gave up..said she cant stamp in the passport without allotting the visa number..said sorry..I cant do anything..I will follow up with DOS ppl and will let you know in a week or so.

    32) The reason she gave is, when she tried to allot the visa, she got a message, "cut off date not established". I have no idea what this means.

    hmmm....still keeping fingers crossed..this is nothing short of a car race.

    IV members, we need your stories. We are going to make an all out effort to pass this on to senators/media folks to realize the urgency of the situation.

    Who's story do we need?
    Your story about how you are affected by retrogression/back log etc. It could be as simple as 'I have a BS in Mathematics and am stuck in back log for 2 years and cannot fulfil my dreams professionally' to 'I have a PhD in Nuclear Science and US needs me coz there are only a handful of us!' Anything and everything works.

    We have literally recieved stories of stay at home moms (because of H4 they cannot work) to folks who have been interviewed by MIT! The whole spectrum helps.....please please send us your stories...we need all the weapons when we go face the senators on behalf of IV

    Why we need your stories?

    Media folks
    Sometimes we get approached by journalists who need a story the very next day. They are looking for specific subjects for the story though.

    An example is say the Investors Business Daily (a financial daily). A reporter might come to us and ask us if we have anyone from the Finance sector who is suffering due to retrogression and is willing to speak up about it. They might also add that we need only Eb1/Eb2 category folks.
    When this happens, we are in a mad scramble to find folks who fit this criteria so that we do not lose this chance.
    Another example might be of a Medical Journal looking for doctors stuck due to retrogression.
    We are constantly getting requests like this but cannot capitalize on it because we do not have enough stories already available to fit the criteria.
    So please send in your stories. It need not be earth shattering at all (most of us are mere mortals). You never know when a reporter is specifically looking for a story similar to yours and you might just tilt the balance in favor of skilled immigrants.

    We promise we will not reveal your story to media if you do not want to.
    Though there is no harm to reveal one's name in media as can be evidenced by the folks featured in the Roll Call article, Philly Inquirer and News Observer.

    At the same time we understand that you might have reasons to remain out of media and we will fully respect that.

    Lawmakers
    Even during the recess, we were talking to the staff of a ton of senators. Most of the time the senators' staff are interested only if someone from 'their constituency' is also affected. We always say we have a ton of folks from each state, but nothing works like a real example.

    For example, when we speak to say Senator Kennedy, it helps us to present the story of folks affected by retrogression and living in say Boston, MA. That way, the staff has some incentive to look into this and get hooked immediately.

    When we initially started meeting senators, their staff would ask QGA 'Immigration Voice, who or what is that?'

    Lately when we go to meet them, most of the staff have already visited our website multiple times, know about us because of phone calls and faxes by members and ofcourse the articles that have been published....on top of this when we provide stories of members from their constituency, 50% of our work is already achieved....the liason team and QGA take over from there.

    I am not on estrogen therapy, but I decided to write about the feelings that I underwent during the 3 days of the event. If you do not want to read the entire post, skip to the last paragraph.

    1. Anxiety: On Sunday, as I was making my way towards Hyatt Regency on the Capitol Hill (a beautiful and an expensive hotel) I was a little anxious about meeting new people (I am a closet introvert :D ). I was not sure if the people would just continue the non-productive conversations about Eb3 vs EB2 or India vs ROW or just be plain annoying. Boy, was I wrong!!! That anxiety disappeared in a matter of minutes after walking in the situation room. The folks were dedicated and meant business. The leadership of the core group was evident, they made sure that we didn't go off message, relatively an easy task for them since most of us there realized the importance of keeping on message.

    2.Excitement: As we started the training, people started pouring great ideas (and few not so great IMHO).The trainer in chief chased each of these ideas to its logical conclusion and without saying whether they had merit or not made it obvious for us to decide. How classy and what a phenomenal coaching style!. The talking points that we discussed were articulated meticulously and question/comments were dealt with insight, experience and facts (this one is very important, we all know what opinions are like...). This was the one feeling (excitement) that lasted through the 3 days and I still cant shake it off (not that I am trying, but I don't want people to confuse me for the energizer bunny!! - we have some one else for that ;))

    3.Nervousness: The first meeting. No, no not with the folks from Congress, but the mock meeting at the training session. The veterans gave us a demonstration of their insights/ knowledge and quick wit. So of course I was nervous coming in after that performance. I volunteered to be on the first ones of these mock sessions and felt all eyes in the room on me. I tried to focus on the task at hand (which was at that time, to stop my legs from shaking ;)). Perhaps, the mock session was the toughest of all the meetings that I had on the hill (remember that the hotel was 'on the hill' too :)).

    4.Awesomeness: This is what it was all about. For me as a first timer, entering the hallowed halls of congress and participating in the democratic process up close and personal is an awesome feeling. Just walking down those corridors and noticing the closed doors with signs that say 'Appropriations Committee', or 'Democratic Caucus' and knowing that laws that affect lives of more than 300 million people are being crafted, debated and being voted on right there....what a rush. I think this too will be with me for a long long time.

    5.Camaraderie: This is a fun bunch of serious people on a mission. I think mostly everyone hit off well with everyone else. I made a whole bunch of acquaintances that I feel could mature into strong friendships. Even though we worked our collective butts off, there was always light hearted humor floating around. It was great.

    6.Gratitude: Looking at the hard work put in by the countless tireless volunteers was a humbling experience. These very kind souls put in hour after hour of work during the event but they put in even more before the event started. I don't know, if the rest of you know, organizing an event at such a scale is a massive undertaking and despite hiccups we came out the other end in great shape. My gratitude goes to all the people that put their hearts, minds and souls in allowing our community to participate in the democratic process at the highest level. Thanks for making this happen.

    Why am I writing this you wonder (or may be not). This event changed me. I felt myself grow in these 3 days. I rubbed shoulders with some of the most famous and powerful men and women in the nation and conveyed our message. I also saw first hand the resource constraints that IV has and how they figure something out and make it happen. Trust me folks, it is not easy to work thanklessly for days on end for 18 hours and still keep a cheerful demeanor but they did. My sincere thanks to IV leadership, all the fellow volunteers and all monetary contributers for allowing me such a great opportunity. Part of me hopes that we never have to do this again, but that hope also makes me sad that I probably wont get to experience a full gamut of feelings again.
    Thanks to all IV efforts. It was indeed a great experience to meet all great IV people from all states and to know them more and learn more about everything.
