Sad, but true, the substitution labor are utilizing the visa numbers a lot.. Not sure if any thing can be done @ this time.... There were lots of new people filed I-140/I-485 utilizing substitution labor in July / Aug 07 as the LC substitution was sunset after wards... Though it is legal :confused: they could have made the PD, they day I-140 was filed, since they allow to retain original PD, now people who really waited are forced to wait even longer.... Now that the program is sunset and also many people already jumped the line, do not see any advantage in complaining about it and expect no administrative reaction to this as labor sub no longer exist... Only solution to retro... is unused visa recapture / increase visa number / exclude dependent / etc... none of these can happen without intervention from congress.... which required very intense lobbying... which in turn requires $$$$ ... and more participation and contribution from the members seems to be the only option that could help all... If you don't help yourself.. no one would !!!

Hi, I'm very tensed. I applied for H-1B under master CAP. I have finished all degree requirements including depositing PhD thesis. However, at the time of filing I could not wait for a letter from the registrar (it takes 5 business days).
So, I filed with a letter from my dept. The letter has the letterhead of the university and states that I completed all degree requirements and will graduate May 13th. It is signed by the dept associate dean.
Would that suffice? Could the petition be denied?
I have seen some denials but all for ppl who hasn't actually completed all requirements at the time of filing.
The petition was filed under regular processing, VSC. I got a receipt notice dated April/24. Online status still shows case pending.

The question in the title of this post is for the user who gave me a red dot for "selling the July VB reversal"
I am going to re-iterate, for I firmly believe I owe my ability to file AOS to this organization!
If you too saved thousands of dollars owing to the VB reversal... this is the least you can and should do to help yourself to a GC, a few years sooner than otherwise.
Contribute funds now to IV!

Thanks for opening this thread.I am sure there be plenty of struggling stories to inspire us fight till we reach our goals. I like the way you are giving small snippets of stories without compromising privacy of the person.
If we can get permission from the person to print these stories on IV website , that would be great read and inspire lot of members.
This person's company promoted him to IT Manager with huge hike and then he learnt from company attorney that he cannot change his role while his LPR is in process. He then got demoted to Sr.Software enginner from IT Manager and the hike was rolled back
This is truly the shocking reality of the life of legal immigrants. We need more and more such stories to pass on to our senators...please keep on sending these stories.....

Does one need to be on an F1 (students) visa to get an assistantship?? Can one work only on university campus while doing their assistantship?? If not where is one eligible to work on assistantship & what type of jobs are available?? My wife is planning to do her CPA on an H4 visa, can she work on assistantship while pursuing it??�Please respond.

If the authorities were really clever they should have accepted the 65000 with highest salaries instead of doing something random like a lottery. This in turn would have forced employers to raise wages to have a meaningful shot at getting a visa.

Or in typical USCIS fashion..whatever they think best :D

Here is exact line-
"IMPORTANT: If your receipt notice date is earlier then the processing date shown, we suggest you call our USCIS Customer Service Office at 1-800-375-5283 for assistance."
Of course, I personally wish that Notice Date takes precedence as it is not our fault that one file just kept on sitting and in saga of moving dates and PD, each day makes a difference.

Go to the authorities and report her.
H1 is a temporary situation. Your family is permanent. Protect your family.
Do not let the fear of social services coming to check on you from stopping to do the right thing. They have a job to do; they will not take away a child unless they really believe that the child is not being cared for. They do not want to add to the strain of foster care system which is already under stress.
Law enforcement agencies also monitor sites like IV, Rajiv Khanna etc. And they can get a subpoena against IV to get your information if they suspect that a crime has taken place.
Everyone: please please ... You should not only check for the cleanliness and background of the staff (and facility) who take care of your kid. Also make sure that their way of taking care of your kid meets your expectation. Do not make any assumptions. Ask pointed questions and get certain answers.
Also... I feel that there is more to the story than what the OP has said in his one and only posting.
I think he/she already went past the point to think "what will happen to me" when they hired someone knowing that she was not legally eligible to work/provide that service.
If not them reporting that nanny, her next victim will report her. I strongly believe that, if she is used to that way of raising a kid, she will hit other kids in the future. And they will be exposed at that point when the authorities grill her to spill the beans on her previous employers.
I am also afraid that the OP might take matters into his/her own by making an emotional decision; and that would put him in hot water.

I hope that was not the only criteria for you to choose her. Keep in mind that a person's behaviour when they are alone speaks of their true nature. They can behave nice and good when they have company; but do they continue to be the same when there is no adult around them?
Definitely install a nanny cam that you/yourwife can keep checking from work.

EB3 quota for this year was exhausted a long time ago. We are not going to see any overflow into EB3 until EB2 has unused visas left at the end of the FY year. Letz just hope that the date moves forward when the new quota starts next month. It was Nov 2001 before it became unvailable. Now that they have quite a few pre-adjudicated applications, they should be able to better forecast the dates it needs to move when the new fiscal year starts. Or, they might just move the date to Jan 02. Letz see in another month what the future says.

Whereas EB3 to EB2 porting is both legal and ethical. When you have a EB3 applicant that is waiting in line for 8 years, he/she had already gathered that much experience based on his long wait. Also, if you look at EB2, it is one of the highly abused category. The EB3 applicant who started in 2001 has joined the line half a decade before the one with 2006 Eb2 PD. One can't really accuse him/her for cutting the line just like one can about substitutes! If the EB3 porting case deserves merit, then I strongly support it!
My intention is not to to start a fight. But we need to see the true picture. Without acknowledging the problem how can we fix it?
Bottom line, GC abuses need to stop and we should fight for it as much as we fight for our rights to get GC!
