I have started the process where my employer is working on the filing. Of course they keep reminding me that EB1 is retrogressed and so I cannot file concurrently. Sunil is right if you mean "actual filing" as the process having started. As for me I am dithering because once I file I will have to sit tight for the whole thing to end and right now there is no end in sight. If I change jobs after filing I will have to go through this whole pain again! Hope this clarifies the situation. Let me know if I can be of any help.

Excellent!!! very well put out! :)

I am not on estrogen therapy, but I decided to write about the feelings that I underwent during the 3 days of the event. If you do not want to read the entire post, skip to the last paragraph.

    1. Anxiety: On Sunday, as I was making my way towards Hyatt Regency on the Capitol Hill (a beautiful and an expensive hotel) I was a little anxious about meeting new people (I am a closet introvert :D ). I was not sure if the people would just continue the non-productive conversations about Eb3 vs EB2 or India vs ROW or just be plain annoying. Boy, was I wrong!!! That anxiety disappeared in a matter of minutes after walking in the situation room. The folks were dedicated and meant business. The leadership of the core group was evident, they made sure that we didn't go off message, relatively an easy task for them since most of us there realized the importance of keeping on message.

2.Excitement: As we started the training, people started pouring great ideas (and few not so great IMHO).The trainer in chief chased each of these ideas to its logical conclusion and without saying whether they had merit or not made it obvious for us to decide. How classy and what a phenomenal coaching style!. The talking points that we discussed were articulated meticulously and question/comments were dealt with insight, experience and facts (this one is very important, we all know what opinions are like...). This was the one feeling (excitement) that lasted through the 3 days and I still cant shake it off (not that I am trying, but I don't want people to confuse me for the energizer bunny!! - we have some one else for that ;))

3.Nervousness: The first meeting. No, no not with the folks from Congress, but the mock meeting at the training session. The veterans gave us a demonstration of their insights/ knowledge and quick wit. So of course I was nervous coming in after that performance. I volunteered to be on the first ones of these mock sessions and felt all eyes in the room on me. I tried to focus on the task at hand (which was at that time, to stop my legs from shaking ;)). Perhaps, the mock session was the toughest of all the meetings that I had on the hill (remember that the hotel was 'on the hill' too :)).

4.Awesomeness: This is what it was all about. For me as a first timer, entering the hallowed halls of congress and participating in the democratic process up close and personal is an awesome feeling. Just walking down those corridors and noticing the closed doors with signs that say 'Appropriations Committee', or 'Democratic Caucus' and knowing that laws that affect lives of more than 300 million people are being crafted, debated and being voted on right there....what a rush. I think this too will be with me for a long long time.

5.Camaraderie: This is a fun bunch of serious people on a mission. I think mostly everyone hit off well with everyone else. I made a whole bunch of acquaintances that I feel could mature into strong friendships. Even though we worked our collective butts off, there was always light hearted humor floating around. It was great.

6.Gratitude: Looking at the hard work put in by the countless tireless volunteers was a humbling experience. These very kind souls put in hour after hour of work during the event but they put in even more before the event started. I don't know, if the rest of you know, organizing an event at such a scale is a massive undertaking and despite hiccups we came out the other end in great shape. My gratitude goes to all the people that put their hearts, minds and souls in allowing our community to participate in the democratic process at the highest level. Thanks for making this happen.

Why am I writing this you wonder (or may be not). This event changed me. I felt myself grow in these 3 days. I rubbed shoulders with some of the most famous and powerful men and women in the nation and conveyed our message. I also saw first hand the resource constraints that IV has and how they figure something out and make it happen. Trust me folks, it is not easy to work thanklessly for days on end for 18 hours and still keep a cheerful demeanor but they did. My sincere thanks to IV leadership, all the fellow volunteers and all monetary contributers for allowing me such a great opportunity. Part of me hopes that we never have to do this again, but that hope also makes me sad that I probably wont get to experience a full gamut of feelings again.

    PotatoEater,

I grow different kind in my backyard. It all depends on the size of your backyard and which zone you live in states. I live in virginia. By this August end /september first week summer crop will end. I grow tomatoes(30 plants), Mint, snake guard, water melons (15 plants), cantaloupes(10 plants), carrots, okra, spinach , chillis. Its fun and hard work too. You need to dig the soil, mix with top soil or garden soil and cultivate it. Every week fertilize it. This is my first year gardening. I have around 3000 square ft of back yard. i do not know what to do with that. I cannot maintain Lawn in back yard. So I decided to grow vegetables.
I am eagerly waiting for my fall garden..I am planning to grow tulips, beets, cilantro, carrots, potato, peas etc., If I can get same space for garden In India and work place just 3 miles from home , I can happily go back to India.

    Hi uma001

I'd be happy if I got a second opinion (my lawyer's is the first) on this issue:
I am ready to file for my AOS(I-485) for the second time based on my employers I-140 petition and would like someone (unitednations ?) to see if there are any possible gotchas.

    Chronology
    ========

#1 May 2001 - Come to US on H1B (California) I-94 valid till Nov 2003
#2 Oct 2001 - Change employers and get a H1 transfer (California) New I-94 valid till Feb 2004
#3 Nov 2002 - Fall in love with an American girl
#4 Dec 2002 - Quit job and move to Michigan to be with girlfriend (Out of status)
#5 March 2003 - Find job in MI, employers lawyer botches my H1 transfer / extension (Out of status)
#6 October 2003 - Fall out with employer and quit.
#7 November 2003 - Marry girlfriend (Out of status)
#8 April 2004 - Wife files I-130/I-485/I-765 (AOS Pending status)
#9 April 2004 - Find a new employer "X" and start working for him
#10 June 2004 - Wife and I have irreconcilable differences and I separate, later file for divorce
#11 June 2004 - "X" petitions for new H1B for me for FY-2005 starting in Oct.
#12 July 2004 - leave US and go back to homeland, get new H1 visa stamped with expiration date of June 2007
#13 Sept. 2004 - Come back to the US with new H1 visa stamp and get new I-94 (exp. June 2007) -----> Fresh start, eh ?
    #14 Nov 2004 - Divorce final
    #15 Dec 2004 - "X" files Labor RIR EB3. PD is Dec 2004
    #16 Dec 2005 - "X" files labor PERM EB2. PD is Dec 2005
    #17 Feb 2006 - PERM labor EB2 approved
#18 March 2006 - Voluntarily went to local CIS office and withdrew old I-485. Proof of withdrawal obtained.
#19 June 2006 - EB2 I-140 filed with copy of labor (Still pending) Obtained receipt
#20 Oct 2006 - EB3 labor approved from backlog center
    #21 May 2007 - File for 7th year H1B extension
    #22 Jun 2007 - EB3 I-140 filed (Still pending). Obtained receipt
    #23 Jul 2007 - H1B Extension approved (new I-94 with expiration of Jun 2008)
    #24 Jul 2007 - Ready to file I-485 concurrent with EB3 I-140

Since 2004 I have maintained valid non-immigrant status (I think). Will I have any issues with accrual of out of status / unlawful stay based on my actions above ?

As you can see, mine is not a straightforward case.

The million dollar question : Based on my actions in steps #4 thru #10, is there a chance that my new I-485 will be adversely affected ? If so, is there anything that anyone can tell me to remedy/rectify the situation to avoid it ?

    Thanks !

From february 2004 (expiry date of i-94 card) until april 1994 it looks like you accrued unlawful presence. The unlawful presence stopped when you filed the 485.

The unlawful presence was wiped out when you left and re-entered usa (the 3 year bar didn't kick in because the unlawful presence was less then 180 days).

    You will be fine.

Just be truthful that you filed 485 before; you had divorce and all the employers that you worked with. Only thing they can get you on is if you try to embelish or hide things even though they were forgiven when you left and re-entered.

A journey of a thousand miles begins with a small step.

~ Lao Tzu (570-490 BC), Famous Inspirational quote by the Chinese Founder of Taoism.

Recently all of us in the IV community were thinking and worrying about what the future holds for skilled immigrants in this country. Day by day things are getting tougher! All of us in IV community (including the leadership) have different ideas about how to approach the problem. Under the IV leadership, we have a set of declared priorities and our lobbyists and community are working for those. Even when we work for those stated goals and priorities, we have to reevaluate what is feasible in the changing environment.

In this increased protectionist environment, Re-Capture, Country Cap Elimination and Immigrant Visa increase seems difficult if not impossible. So, I would like to propose a SMALL STEP, which would provide us HUGE BENEFITS and at the same time satisfy all stakeholders (including anti-immigrant community) as this is the least controversial method.

Some of us may say that this wont work. Some of us support a big-bang theory. Some others argue for the already stated goals and priorities from the IV leadership team. I agree with all these groups of our brethren, but at the same time, I urge each and every member of our community to give a serious consideration of this proposal before shooting it down.

Please do not use this thread to point fingers at one another. Always remember, when you point fingers at someone, three of your fingers are pointing towards you and one stays neutral. Please try to avoid statements like the following in your reply to this post to encourage serious and productive discussion:

Why didnt you update your profile with all information?
What have you done so far for the community?
Did you participate in these so and so initiatives of IV?
You are a line cutter who used substitution
Etc etc etcthe list goes on.

We have far more things that unite all of us than the few things that divide us. So, let us focus only those things that unite all of us. If we are united, we can easily solve all our differences. As AR Rahman said, always we have the option of choosing love over hate.

    PROPOSAL

Our main concern with respect to GC journey is the UNCERTAINITY! I am sure all of us worried at least one time What happens if my 485 gets denied after all these years of waiting? Many of us here are expecting a GC wait time of 2-12 years. So, a denial at the end would be little bit disheartening.

The normal processing time of a 485 application ranges from 4 months to 12 months. For all the retrogressed countries, this would be 2-12 years. All of us, who are in the Adjustment of Status category, are legally allowed to stay and work here in the US. So, in no way we are additional burden to the country. So, all the shackles on the GC applicant and family during the years of retrogression period are not beneficial to anyone in this country and it is not protecting anyones job. These shackles just inflict pain to the GC applicant and family that's all - nobody is benefitting from this!

So, if we can work to obtain Adjudication of all I-485s irrespective of whether the country is retrogressed or not we have a solution. As per the INS rules, an immigrant VISA cannot be allocated outside the numerical limit. If the country is not under retrogression, the applicant will get his GC. If the applicants country is a retrogressed one, instead of obtaining the Green Card, I-485 processing-status could be changed to a new one such as Adjudicated Pending Visa Allocation (meaning: Adjudication completed, Visa allocation pending). So, in essence, when the VISA numbers are available, then only the person will get Green Card. But at the same time, the applicant and family can feel the relief No need to worry about RFE, NOID, MTR etc, because the 485 is already approved and it is in a Pending Visa Allocation status. So, in the case of all these retrogressed countries, the actual allocation of Green Card may take 2-12 years time depending on the availability. This option will go well with the protectionists.

If the status of the 485 application is Adjudicated Pending Visa Allocation and the applicants country is a retrogressed one, S/he should be eligible to obtain 3, 4 or 5 year EADs with travel benefits associated. Also, the applicant should be able to take any job after 1 year of the status change date of the status Adjudicated Pending Visa Allocation.

I believe the above proposal is a small step in the eyes of the protectionists where as it is a big leap for all retrogressed country applicants. We may be able to achieve this using administrative fix or an action from the Executing branch, as this wont change the annual GC quota of 140000. Apart from this, this will encourage all those skilled immigrants to invest in American economy within 1-2 years of filing AOS application. At present most of us are sending our money to our home countries as our situation is so uncertain. This effort will definitely help the ailing economy and will serve as a boost to the housing market.

Whom should we approach to get this done?

Ans: Hillary Yes Hillary Clinton. She is the number 1 friend of people from China and India, who is in the current administration. Her department is also in charge of the 140K Visa numbers, Travel related visas etc. If we can get support from Compete America, prominent members of Indian and Chinese communities in US, Ambassadors of China and India to US and approach Hillary, we will be successful. Hillary may be very much pleased to start an initiative to achieve this, as she has a chance to influence 700K+ Indians and Chinese immigrants in US, in a very positive way. At the same time, politically this wont create much problem Status quo will remain the same even after such an administrative fix. There is no net addition of immigrants to this country.

With Hillarys support, if we approach Janet Napolitano, we may have a solution.

Remember: A journey of a thousand miles begins with a small step.

So, once we obtain this admin fix (first step), then we will work to obtain the Allocation of GC issue for all those folks who are waiting to get the GC allocated.

Every progress starts from a dream. So, if someone would like to call this a dream, please feel free to!

    Guys,

Please DO NOT vote "Yes" if you are not intending to contribute $25 for this cause. Whoever enters yes, I will pursue and make sure we get contribution before 31st March. Please make sure you send me PM with your contact information if not paying withing a week.

Please please please, do not put junk on this forum. Keep bumping up anyways.

Core, no offense meant, but please don't shy voting on this. I usually don't see core voting, understandable but keep this as an exception.

    P.S.

Based on multiple IM to me on this issue:

I am trying to set up something with IV so that the contribution specifically will go for this cause. Any access money will be transferred to IV regular account. I will publish the account summary at the end of effort for transparency reasons.

Please be specific how to remit this amount ?

    Hi,
I am married and my husband is working in US on H1B visa. I came into the country with an L1 visa in Dec '06. The I 94 is valid till Oct 2009.
In Apr 2007, I applied for my H1B and it was approved with a start date of October 2007.
I quit my company by end of May 2007. Since the H1B was NOT applied with COS, I applied for my H4 last week but I have not got the approval notice for H4 yet. :(

Is it still possible for my husband to file my 485 along with his? What do I enter for questions regarding my current status?? Can I say that my current status is H4 and give the "valid till" date as the end date of my husband's H1B date?
    Please help!!!

    Thanks Elfreda

Even though most of other lawyers were skeptical about it. You guys did it.
I think IV Campaigns, Zoe's response and AILF's lawsuit are three main contributing factors in this success.

    Congratulations!!

Sorry that I had to wait this long to contribute. Been tight with my debt and payments and also secretly monitoring this board and praying for your success. My first contribution of $20 was sent via paypal.

I personally feel that not a lot of people out there know about paypal or are just too scared to transact online.

It would be awesome if a portion of the money could be used to start a mailing campaign via snail mail by including a contribution plea letter along with a form that can be filled and mailed with a cheque to IV. Just like those credit card offers. Obviously to all the registered members.

Also, psychologically, when you navigate to the contribution page, the list of contribution amount options starts with $100. And then all the way to the right is the "other" option. It takes time for the eye to get to the "other" amount option as a result of which an anonymous/interested user navigating to the page sees contribution amounts in multiples of $100 thereby creating doubt/hesitation without realizing that you can choose the "other" option to contribute in smaller numbers. It would be great if you could put in a blank text field first and then the other options with multiples of $100.

    Just my 0.02 cents.

Keep pushing and for all you guys watching in the sidelines watch "Gandhi" - the movie, for inspiration. Seriously!

Even if you don't contribute, walk up to Blockbuster or go online on Netflix and rent the movie out.

IV is doing a tremoundus job. I have been watching and waiting silently until I saw the movie "Gandhi".

I know many of you single non-immigrants living alone don't have to shop around for Christmas. I know I don't because my family doesn't live here. So maybe you can gift IV with a small contribution.

Maybe you can skip a carwash this month (for all those living in the south, i.e.) and do it yourself and send in the money to IV. Small drops of water make an ocean. So don't think your contribution, however small it may be, is not going to help.

If you really don't have the money to contribute, atleast buy a $1 greeting card and a $0.39 stamp and send it to IV thanking them for fighting on your behalf. Its that simple.

    Good luck and god bless.
Thanks for your contribution and appreciation for the work IV and its members are doing.

    Hello guys,
Sorry for this non-immigration related post. We have this sudden, tragic situation that I wanted all of your advice on. Thank you for your time in reading this long post.

We had hired an Indian nanny in NJ who, we learnt after hiring her, is here on a tourist visa. We were paying her $350 per week cash, which is the standard rate around here for nannies (incl. citizens and people on GC). We had liked her when we met her in response to an ad on Sulekha, and we thought an Indian nanny would be good for our first child. She has been with us for about 3 months, and we were intermittently not getting a good feeling with her for some reason. We finally bought a small security camera and installed it yesterday. On the very first day with the camera, we came home and saw the recorded video to find that she is violently hitting the baby on two separate occasions. Needless to say, it has shocked, angered and extremely saddened us. I showed the video to a couple of friends and even they say it is unbearable to watch. This was just the first day of recording and it pains us tremendously to think what all may have happened previously.
She is of course not going to stay with the baby alone anymore, but I want to know what legal options I have to penalize her to the fullest extent, so that she does not do this to anybody else’s small babies. She it seems had come here last year and taken care of someone else’s baby in Hoboken, and I can imagine that their baby also went through this. (This woman and her husband are a ~ 35 year old couple, who have a multiple entry ten year tourist visa; both come here for 6 months every year and work odd jobs like this. They apparently got a (unsponsored) tourist visa after showing a lot of landed property in India).
I specifically want to know if I will have potential problems if I go to law enforcement about this- regarding have employed her (both of us are on H1B visas). I know we have made mistakes and should have done better due diligence in this, and there cannot be any more punishment for us than seeing our 8 month old – who cannot tell us about it when we come home- being beaten on the tapes. We saw this yesterday and have not told her yet. We want to weigh all options before we proceed, but from today onwards one of us is home all the time till Friday. Any advice or opinion is sincerely appreciated. Thanks for reading this long post. And, to all who are thinking of nannies or have one, please learn from our mistakes and closely monitor your child’s safety every day.

Thunderbold, Sorry for your situation. Here is my observation/suggestion.

Being an immigrant you have broken the law by hiring someone to work illegally. Didn't you and your wife break the law?

You have already witnessed a child abuse and now pondering whether to report this to a law enforcement or not. Again you are breaking the law by not reporting a child abuse. Remember, abetting a crime is also a crime.

This country has given us so much including good wealth and health(except GC) and we enjoy every thing, but in return what we do is to do these kind of illegal activities.

This country let us and our spouse to work, make hell lot of money. I am not saying we are making easy money, but after having two incomes, we run around with coupons and look for cheap things or do things that are cheap. WHY?

What are we going to do with that money man? This is nothing but a greediness.

Anyway, your child has gone thru a nightmare and as a parent/father you MUST report this to a law enforcement office. You can not let this child abuser go scot-free.

Note: When you can hire a nanny that is legal/citizen for $350/week, then why did you hire someone illegal?
