Its high time since we spent in doing the guesswork. But sadly that's the only way to get out of the mental agony any one in EB3 stands as of now.
Even obama has indicated that immig reform is in the attic and also visa bulletin site shows wordings like that 10000 numbers for EB3 has been cut to 5000 (it must be saying from long time back itself) which is another pain in the already open wound of EB3.
Good at least EB2 moved but sad story continues for EB3. My guesswork is that for EB3 some daylight will be possible only around feb 2010. If no moves happen even in next year then its s%^t for all of us in EB3.

It may help if you ask senders to sanitize their story themselves, and report it to you in 3rd person.
Eg:

However during some time in 2006, the company was in deep trouble, management takeover etc. and we were only paid for time spent on a major project (which was the cash cow). Because i was not directly involved in it, I was paid at about 50%, but every week, which lead my final W2 for 2006 to be around 76% of the total on the LCA. I looked at my paystubs and the total weeks at less than 100% is 5 months.
For 2004, 2005 and 2007 (on course) I am on course for my full salary. Also I got a bonus and stock options as the project took off and we are all in a better shape and my 2007 W2 should be higher.
Before 2004, I was a student on a F1 (MS degree) with one h1 in the bad days of 2002. However, my change of status was on the dot.. i.e. i got laid off on a friday and i filed my change of status to f1 the same day. My h1 visa was stamped in 2004 in India. My H1 was extended in early 2007

Ask your employer to pay you back wages with a letter saying due to financial conditions they could not pay you blah..make your arrangement to take a pay cut or whatever. File an amended return and include that in your 485 application.

If you get caught on something that can be easily rectified and you dont have a way to explain it then there is a chance for denial. There is a somewhat similar case of 485 denial ( he was not paid for 2-3 months) though he worked for the employer and he did not get back wages nor filed with DOL to get them back.
If you want to play it safe you can wait till 2008 and get your extension and then file 485 ( but would the dates be current? dont know and then file an amended tax and include proof in the 485 application)

Please see one of the replies I have above in response to another post. You employer could not pay you, but it is not your fault. If a RFE comes up, you can file affidavits to that effect. You have to consult a good lawyer.
If you are not going to be leaving the US, you shouldn't have to worry about the H1 stamp because you should be getting a new I-94 with your H1 extension approval notice.

Let me start by repeating myself, it is not about EB2 or EB3. We all are EB communities. We didn't design the system, neither we believe ourselves to be superior to EB3. The point is all of us need to work together and help ourselves to change the system. IF EB2 gets some advantage then ultimately it will help EB3 as well.
It is a simple logic, when the cake gets cut it rolls down to all the people in line. If there is no cake, whats the point of arguing who is ahead in line?
Please everyone, stop complaining about who is ahead, work together. Instead of complaining do some more constructive, involve more people. lets gather necessary means to file this lawsuit.

I'd like to take this opportunity to thank each one of you on the immigration voice core IV team for your dedication and perseverance and, congratulate all of us on this triumphant success with the USCIS decision in our favor. I very closely watched the immigration voice threads, especially, over the past week and don't think would have found a better blogspot for realtime updates and advice. Its been a tough time for most of us and that was sure evident with rising tempers on the forums and restlessness that was tangible. I think a celebration is in order. Cheers!!! ;)

Hi,
I am married and my husband is working in US on H1B visa. I came into the country with an L1 visa in Dec '06. The I 94 is valid till Oct 2009.
In Apr 2007, I applied for my H1B and it was approved with a start date of October 2007.
I quit my company by end of May 2007. Since the H1B was NOT applied with COS, I applied for my H4 last week but I have not got the approval notice for H4 yet. :(
Is it still possible for my husband to file my 485 along with his? What do I enter for questions regarding my current status?? Can I say that my current status is H4 and give the "valid till" date as the end date of my husband's H1B date?
Please help!!!

This is not about illegal immigration, this is bout how sheriff Joe uses the nativist sentiment of Arizona for his own political interest. I have been residing in sheriff Joe's jurisdiction for 5 years now and violent crime has gone up more than 60%. Response time to emergency calls is up drastically, and I have personal experience of that. There are 40,000 felony warrants pending on sheriff�s desk, and yet he takes his 50 deputies for so called illegal immigration sweep, which contributes only fraction of a percent to the number of deported illegals from Maricopa County. He has been absolutely successful in creating an anti illegal image that keeps him in his seat for years.

Most people think law suit is a bad thing, but that is not right. In a democratic country law suit is the right way to deal with things. We are legal immigrants, we have all the rights to file a law suit, but with full support of IV.
People have already filed a law suit on the same day the President signed the bill! (yesterday, the wire tapping bill...)
By filing a law suit, all we are trying to do is to fix the laws which are not working. Basically, we are doing the right thing. Not only us, but future Legal immigrants will be benefitted, they don't have to go thru what we had to...
Here are the things that needs to be fixed...
1. Country quota
2. Recapturing visas..
3. 3 year EAD/AP
4. End the endless wait ( Proposing a new law ;))
What is "End the endless wait" ?
EAD is a very good example, If 90 days have passed after filing EAD, you have the option to go to a local USCIS office and get a temp one. We should have a similar option for all the peper work. For example, each and every stage in green card process should have a a day count for processing. Like name check should be completed in 180 days.
Basically, when we receive any receipt notice, it should have a statement which reads "We have received your application and we will take action within 180 days. If we fail to act by MM-DD-YYYY, Please go to the nearest USCIS for approval.."
Sounds little ambitious ?? well, we are not asking for too much, just a day count. Lets say if the whole Green card process takes 3 years or 10 years based on the day count for each stage, people can decide whether they want to immigrate to USA with a clear idea that it will take x days to become a permanent resident ( like how it works in all other countries except USA)
Even a person jailed gets to know how long he is going to spend his time behind bars, but we do not know when we will be free from this immigration mess!

[B]The spill over from FAMILY CATEGORY can only be used starting from SEPTEMBER 01 2008. Otherwise it won't go with the interpretation of the law.
Also the spillover from EB1 (for august 2008 and anything remaining for the current year) will be applied on September 01.

I was watching CSPAN last night and both Senate majority leader and minority leader were talking about what they are planning to do in the next few weeks, Minority leader Senator Mitch McConnell talked about the Omnibus Bill and few other appropriation bills and he was hinting that they are planning on getting some of these done before Christmas. According to him, the congress does not have any other choice but to get these passed ASAP. This is the best time to attach and just ride the wave.
If we are to get anything done about our sorry state, this is it.
We need everyone to contribute.
Don�t think that IV will somehow find the money and do this on behalf of the community.
It is not the reality.
We need members to pitch in.
This is too important to ignore, I am sure if we don�t do anything now we will be regretting about the opportunity we had and how we didn�t do anything. We will not see another opportunity for at least an year.
Now click on the Contribute button and do your part..
I will guarantee you one thing; you will feel good that at least you did what you could instead of waiting on the side lines.

Every single person who came to DC this time or the time before, or who came to San Jose rally has been told by friends, family and colleagues "Why are you going to DC, let others go, take care of yourself, all problems get fixed eventually, Congress will take care of it".
They sound very reasonable or try to convince you that they are the reasonable ones and you are being unreasonable by going to the Capitol and working on your cause.
The truth is...yes, we may be. But we are the ones who will eventually make a difference. If you read the quote from George Bernard Shaw, you will realize that the reasonable men and women will sit around and talk about us, save their time for family and leisure and comply themselves to the system. They will comply themselves to a system that keeps in hanging without a green card for 20 years. They will never be capable of ushering progress.
The unreasonable ones, the ones like us, who contribute to this cause in various forms, are the gifted ones. We are the lucky ones. For we have the wisdom and the strength to do the unreasonable and get the world to comply to our point of view.

I wish the problem of greencard backlogs get cleared soon, but if it doesnt, I will do this a 100 times again and with same or more passion, determination and purpose. Our energy and determination would outlast and outlive the intertia of Congress.
Not having participated in any previous efforts, the skepticism I had when I landed in DC vanished the moment you started the training session. You are right, if we are not goaded into action, we are content to refresh the visa bulletin every 1st Friday of the month - why 20? 50 times a day!!
Never once did I realize that by clicking on refresh button - I am actually doing nothing to change the outcome of what will be published. However, during the training, during our lawmaker meeting in DC - I realized I AM ACTUALLY WORKING TO CHANGE THAT VISA BULLETIN
I realized that my participation will not bare immediate fruits but just that I added a good dose of Miracle Grow and Water. The amount of sunshine is controlled by the powers beyond me, but IV and I are working to make sure that our plant does not get overshadowed by larger trees. Will I be ready to add more Miracle grow in the next 4/5 months? ABSOLUTELY.
Every IV member can take this as a challenge or as a request - watch the political environment and follow what is happening on the IV forums and action items. As things get warmer, talk to your bosses, spouses and be prepared to participate in Lobby or Rally efforts that will propel our issues to the forefront and get the solutions (be it in whole or partial). Be prepared to participate. Find reasons to participate in such efforts and not excuses/contention/indifference. If you can't do it, find others to take your spot. Do what it takes.
We may be high skilled in technology but we have a long way to go in terms of communication - and to find you LOGICLIFE, an excellent communicator - it is a privilege, be trained by him, and to actually be in a meeting with him - Priceless.
Lastly, I want to say, that I have become so "Unreasonable" and am trying to convince every friend of mine to be active in IV for our issues, that I have come to a point where I want every high skilled immigrant to perceive solutions to immigration the way I do!!!

They sound very reasonable or try to convince you that they are the reasonable ones and you are being unreasonable by going to the Capitol and working on your cause.
The truth is...yes, we may be. But we are the ones who will eventually make a difference. If you read the quote from George Bernard Shaw, you will realize that the reasonable men and women will sit around and talk about us, save their time for family and leisure and comply themselves to the system. They will comply themselves to a system that keeps in hanging without a green card for 20 years. They will never be capable of ushering progress.
The unreasonable ones, the ones like us, who contribute to this cause in various forms, are the gifted ones. We are the lucky ones. For we have the wisdom and the strength to do the unreasonable and get the world to comply to our point of view.
And flower campaign, the DC rally -- that got bulletin reversed in 2007,
the popularity of removing per-country ceilings in the offices that exist today and didnt exist before --
All this a work of men and women like us who are unreasonably resilient, who will not listen to the advise of reasonable men who sit on the sidelines and refresh the Visa Bulletin page every first friday of every month 20 times a day.

I wish the problem of greencard backlogs get cleared soon, but if it doesnt, I will do this a 100 times again and with same or more passion, determination and purpose. Our energy and determination would outlast and outlive the intertia of Congress.
Not having participated in any previous efforts, the skepticism I had when I landed in DC vanished the moment you started the training session. You are right, if we are not goaded into action, we are content to refresh the visa bulletin every 1st Friday of the month - why 20? 50 times a day!!
Never once did I realize that by clicking on refresh button - I am actually doing nothing to change the outcome of what will be published. However, during the training, during our lawmaker meeting in DC - I realized I AM ACTUALLY WORKING TO CHANGE THAT VISA BULLETIN
I realized that my participation will not bare immediate fruits but just that I added a good dose of Miracle Grow and Water. The amount of sunshine is controlled by the powers beyond me, but IV and I are working to make sure that our plant does not get overshadowed by larger trees. Will I be ready to add more Miracle grow in the next 4/5 months? ABSOLUTELY.
Every IV member can take this as a challenge or as a request - watch the political environment and follow what is happening on the IV forums and action items. As things get warmer, talk to your bosses, spouses and be prepared to participate in Lobby or Rally efforts that will propel our issues to the forefront and get the solutions (be it in whole or partial). Be prepared to participate. Find reasons to participate in such efforts and not excuses/contention/indifference. If you can't do it, find others to take your spot. Do what it takes.
We may be high skilled in technology but we have a long way to go in terms of communication - and to find you LOGICLIFE, an excellent communicator - it is a privilege, be trained by him, and to actually be in a meeting with him - Priceless.
Lastly, I want to say, that I have become so "Unreasonable" and am trying to convince every friend of mine to be active in IV for our issues, that I have come to a point where I want every high skilled immigrant to perceive solutions to immigration the way I do!!!

I am very proud to be a member of IV.I am very happy today. Today you have witnessed a small victory. We know we have a long way to go.
